The act also identifies an organizations supervisor as part of its management. This means that a supervisor is an organizations agent and the organization is therefore vicariously liable for its supervisors actions (Bramball, 2012). The same act however identifies managements right to influence unions elections through tactful initiatives (DeCrew, 2003). Applying these principles supports my conclusion to uphold the elections because even though the supervisor made repeated appearances near the unions meeting, his action does not communicate any form of threat to retaliate on the union. This undermines applicability of threat of reprisal against the union.
